These Terms of Service (“Terms”) govern your access to and use of www.victrasports.com and related services (collectively, the “Services”) operated by WG Sports, Inc. (“Victra Sports,” “we,” “us,” “our”).

By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

2) Eligibility and accounts

• You must be at least 13 years old to use the Services. If you are under 18, you may use the Services only if your parent/guardian permits it.

• If you create an account, you agree to provide accurate information and keep your login credentials secure.

• You are responsible for all activity under your account.

3) Privacy and cookies

Our Privacy Policy explains how we collect and use personal information. Our Cookie Notice explains cookies and similar technologies. By using the Services, you acknowledge these policies.

4) Subscriptions, billing, and no refunds

If you purchase a subscription (monthly or annual), you agree to the following:

• Billing: Your subscription will renew automatically unless you cancel before the renewal date.

• Payment processing: Payments are processed by Stripe or another designated payment processor. We do not store full payment card details.

• No refunds: To the fullest extent permitted by law, all fees are non-refundable, including for partially used billing periods.

• Price changes: We may change subscription pricing or features. If legally required, we will provide notice before changes take effect.

• Cancellation: You can cancel your subscription at any time. Cancellation stops future renewals; you will retain access through the end of the current billing period unless otherwise stated at checkout.

• EU/UK consumer note: If you are in the EU/UK, you may have mandatory rights (including potential withdrawal rights for certain purchases). Where such rights apply, nothing in these Terms limits them.

5) Your use of the Services

You agree not to:

• Use the Services for unlawful, harmful, or abusive purposes.

• Attempt to gain unauthorized access to accounts, systems, or data.

• Interfere with the Services (e.g., scraping, automated abuse, bypassing access controls).

• Upload or share content that is defamatory, harassing, hateful, sexually explicit, exploitative, or that endangers minors.

• Infringe intellectual property, privacy, or other rights of others.

We may suspend or terminate access if we believe you violated these Terms.

6) User content (posting, profiles, uploads)

If the Services allow you to post, submit, upload, or transmit content (“User Content”):

• You own your User Content and remain responsible for it.

• License to Victra Sports: You grant Victra Sports a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify (for technical purposes like formatting), display, distribute, and make your User Content available in connection with operating, improving, and promoting the Services.

• Your promises: You represent that you have all rights necessary to submit User Content and that it does not violate law, these Terms, or third-party rights.

• Moderation: We may remove or restrict User Content at any time (including for policy violations, safety reasons, or legal compliance).

• No expectation of confidentiality: Do not post anything you consider confidential.

7) Community safety (including minors)

You agree to comply with our Child Safety Guidelines and any community rules we publish. We may take enforcement action (content removal, account suspension, reporting to authorities where required) to protect users and the platform.

8) Intellectual property

The Services (including text, graphics, logos, UI, and software) are owned by Victra Sports or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, sell, lease, or reverse engineer any part of the Services except as permitted by law or with our written permission.

9) Third-party services and links

The Services may include third-party content, links, or integrations (e.g., Stripe). We do not control third-party services and are not responsible for them. Your use of third-party services is governed by their terms and policies.

10) Copyright complaints (DMCA)

If you believe content on the Services infringes your copyright, email team@victrasports.com with subject line “DMCA” and include:

• Identification of the copyrighted work

• The URL/location of the allegedly infringing material

• Your contact information

• A statement you have a good-faith belief the use is unauthorized

• A statement, under penalty of perjury, that your notice is accurate and you are the rights holder or authorized agent

11) Disclaimer of warranties

The Services are provided “AS IS” and “AS AVAILABLE.” To the fullest extent permitted by law, Victra Sports disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the Services will be uninterrupted, secure, or error-free.

Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.

12) Limitation of liability

To the fullest extent permitted by law:

• Victra Sports will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenues, data, or goodwill.

• Victra Sports’ total liability for any claims relating to the Services will not exceed the amount you paid to us in the 12 months before the event giving rise to the claim (or $100 if you paid nothing).

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

13) Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless Victra Sports and its officers, directors, employees, and agents from claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your User Content, or your violation of these Terms or applicable law.

14) Termination

We may suspend or terminate your access to the Services at any time if we believe you violated these Terms or if we must do so to comply with law. You may stop using the Services at any time. Sections that by their nature should survive termination will survive (including IP, disclaimers, liability limits, indemnity, and dispute resolution).

15) Changes to the Services or Terms

We may update the Services and these Terms from time to time. If we make material changes, we will post the updated Terms and update the effective date. Your continued use after changes means you accept the updated Terms.

16) Governing law and venue (multi-market)

A. United States users: These Terms are governed by the laws of Delaware, excluding conflict-of-law rules. You agree that disputes will be brought in the state or federal courts located in Delaware, unless applicable law allows otherwise.

B. EU/UK consumers: If you reside in the EU/UK, you may benefit from mandatory consumer protections in your country of residence, and nothing in these Terms limits those rights. Where required by law, you may bring claims in the courts of your country of residence.
